Privacy protection

Her Karolina Ławicka (hereinafter referred to as „HER” or „Administrator”) attaches particular importance to respecting the privacy of Users visiting the website administered by HER (hereinafter referred to as the „Website”). The data collected is used solely for the purposes of administering the Website. Servers automatically record data such as the page request sent by the User, the date and time of the request and the response, device data (e.g. hardware model), browser type, browser language, and operating system type. Most logs (server logs) are not associated with any specific User. All User data obtained through the Website is intended for HER's use.

Data collection

  1. All data obtained from Website Users is collected in two ways:

We request that users provide their personal data when using registration and contact forms for the purpose of registering, ordering goods or services, submitting complaints or enquiries. During registration, the Administrator informs the User which data (listed in the registration form) are necessary for the provision of services and indicates which data in the form are additional data that do not affect the registration process.

  2. a) IP address – every computer connected to the Internet has a unique number assigned to it, i.e. an IP address; on the basis of this number, it is possible, for example, to identify the country from which a given User connects to the network. HER reserves the right to store additional logs within the website that link the IP address to the customer's account. These logs are used solely for the purpose of analysing any technical problems with registration, logging in and using the website.
  3. b) text files (cookies) sent to the User's computer when visiting the website. Cookies only store data required by the website for proper functioning, including the identification of the currently logged-in User. The User's personal data may be displayed on the website when visiting their account in the E-SHOP or on the HER website.

HER processes personal data in accordance with the consent given by the User and in accordance with applicable law, including: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and the implementing provisions issued on the basis of this Regulation.

Cookie mechanism

The term „cookie” as used in this document refers to cookies and other similar tools described in Directive 2009/136/EC of the European Parliament on the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications) and Article 173 of the Telecommunications Law.

  1. Your web browser may store cookies on your computer's hard drive. Cookies contain information necessary for the proper functioning of the Website. Cookies are small files stored on the User's end device, used to identify the User's browser when using our Website. Cookies provide the Administrator with statistical information about User traffic, User activity and how the Website is used. They allow the content and services to be tailored to the User's preferences.
  2. The contents of cookies do not allow for the identification of the User.
  3. Cookies are not used to process or store personal data of Website Users.
  4. Cookies are not used to obtain any information about Users, except for information about their behaviour on the Website. HER uses Google tools to track the activities of Website Users. In this case, cookies are used to store information, e.g. about the time of the User's current visit, whether the User has visited the website before, and from which website the User came to the website administered by HER.
  5. HER stores cookies on Users' computers for the following purposes:

  1. properly tailoring the Services to the needs of Users and optimising the use of websites;
  2. remembering the User's preferences and individual settings, allowing the Website to recognise the User's device and display a website tailored to their needs;
  3. creating Website viewership statistics, which help to understand how Website Users use the websites, enabling their structure and content to be improved;
  4. maintaining the Website User's session (after logging in), thanks to which the User does not have to re-enter their login and password on every subpage of the Website;
  5. saving basket data in the online shop so that it is not lost when you revisit the Website.

    VI. Types of cookies used on websites administered by HER.

1. Due to the lifetime of cookies and other similar technologies, the following files are used:

a) „session” cookies, i.e. temporary files that are stored on the User's end device until they log out, leave the website or turn off the software (web browser).

b) „persistent cookies”, which are stored on the User's end device for the time specified in the cookie parameters or until they are deleted by the User.

2. Due to the purpose of cookies and other similar technologies, the following types of files are used: 

a) „necessary” – cookies enabling the use of services available on the Website, e.g. authentication cookies used for services that require authentication on the Website;

b) security cookies – cookies used to detect authentication fraud within the Website;

c) „performance” cookies enable the collection of information on how the Website is used;

d) „functional” – cookies that enable the „remembering” of settings selected by the User and the personalisation of the User's interface, e.g. in terms of the selected language or region from which the User originates, font size, website appearance, etc.;

e) „advertising” – cookies enabling the delivery of advertising content to Users that is optimally tailored to their interests. 

VII. The User has the option to configure their web browser to completely or partially disable the storage of cookies on their computer's hard drive. These settings can be changed, in particular, to block the automatic handling of cookies in the web browser settings or to inform the User each time they are placed on the Website User's device.

Processing of personal data

I. The data collected within the Website is used to provide specific services to our Users and for administrative and statistical purposes, as well as to protect the Website. HER collects and processes the following personal data of customers: first name, surname, gender, date and month of birth, delivery address (correspondence address), e-mail address, telephone number.

II. The personal data obtained is processed for purposes related to the necessary activities associated with the performance of the contract, in particular the processing of orders, sending text messages or e-mails (depending on the personal data provided to us) with information about the status of the order, or contact in the event of problems with the performance of the order.

III. The purposes of personal data processing may also result from legitimate interests pursued by HER, including:

a) direct marketing of the controller's own products or services,

b) the administrator's pursuit of claims arising from its business activities,

c) participation in the loyalty programme,

d) withdrawal from the contract,

e) handling complaints,

f) sending out surveys aimed at obtaining information on the quality of services,

h) registering for competitions organised by HER.

IV. Where the purpose of personal data processing is marketing activities
and the transfer of commercial information, including, for example, receiving messages in the form of a free newsletter, information about promotions and events organised by HER, the basis for processing is the consent of the data subject. When requesting consent, we inform the User about the exact purpose of data processing in the information clause. The User's personal data will be processed until consent is withdrawn. HER reserves that, due to the synchronisation of activities, pseudonymisation/anonymisation from the User's data system may take up to 72 hours from the moment of objection.

 V. HER may collect and process user data in the form of an e-mail address and, possibly, other data provided voluntarily by the user (e.g. first name, surname) for the purpose of submitting a complaint or making comments. In such a case, the provision of personal data is voluntary, but necessary for the complaint to be considered or for a question to be answered. By providing personal data, the user agrees to the processing of personal data solely for the purpose of considering the complaint or responding to the question.

VI. The recipients of personal data processed by HER will only be external entities supporting the handling of orders or complaints, ICT systems and debt collection. Your personal data will not be transferred to other recipients in third countries or international organisations.

VII. The data collected through the websites will not be sold or made available to other institutions, organisations or individuals who are not employees or regular associates of HER. Access to the data is granted to companies cooperating with HER that support the operation of the system, as well as to Google Inc. through the use of data for statistical purposes of Google Analytics and advertising purposes of Google AdWords.

VIII. Your personal data is subject to profiling, which involves analysing transaction and personal data (gender) in order to best match the marketing content necessary for the proper implementation of the HER loyalty programme. However, HER will not make any binding decisions about you in an automated manner.

IX. Based on information obtained through the Website, HER may compile aggregate statistical reports which may be disclosed to third parties. However, such reports do not contain any data that would allow individual Users to be identified.

X. HER ensures that Users can exercise their rights under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and the implementing provisions issued on the basis of that Regulation, in particular: the right to access and rectify their data, the right to erase data (to be forgotten) or restrict its processing, the right to object to the processing of data for purposes other than those indicated above, the right to transfer data, the right to withdraw consent at any time, the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office). Safety

  1. HER makes every effort to protect the Services from unauthorised access by third parties. To this end, we use, among other things, firewalls, server security devices, encryption devices and physical security measures. At the same time, we would like to draw your attention to the fact that Users should not disclose their registration data to third parties, in particular their account password (i.e. their date of birth, which is also used to activate vouchers at the checkout), and should use the „log out” option after finishing using the content and services offered by our websites.
  2. The HER website contains links to other websites. We recommend that you familiarise yourself with the privacy policies of these websites when you visit them. HER is not responsible for the privacy policies of websites linked to from the HER website.
