TERMS AND CONDITIONS OF THE ONLINE STORE WWW.HER-HER.EU

I. General provisions

  • These Terms and Conditions (hereinafter referred to as the „Terms and Conditions”) set out the general terms and conditions for placing Orders in the HER-HER.EU online shop (hereinafter referred to as the "Shop") located at www.her-her.eu.
  • The owner of the Shop is Her Karolina Ławicka – with its registered office at ul.Bałtycka 26 Poznań, Tax Identification Number (NIP): 7772600353, e-mail address: office@her-her.eu.
  • The prices listed in the Shop are expressed in Polish currency (PLN) and are gross prices. Product prices do not include delivery costs.
  • In the remainder of these Terms and Conditions, a person intending to purchase goods from our online shop is referred to as the „Customer”.
  • Purchases in the Shop may only be made by adults or by legal entities or organisational units without legal personality.
  • Before placing an order, the customer is obliged to read and accept these Terms and Conditions. Acceptance of the Terms and Conditions is a prerequisite for using the Store's services and takes place when filling out the order form.

II. Definitions

The terms used in these regulations mean:

  • HER: Online shop located at www.her-her.eu
  • Terms and conditions: these Terms and Conditions concerning the provision of electronic services within the HER-HER.EU Online Shop.
  • Seller: Her Karolina Ławicka – with its registered office at ul.Bałtycka 26 Poznań, 61-017 Poznań, NIP (Tax Identification Number): 7772600353, REGON (National Business Registry Number): 38404288300000. The owner of the Her Karolina Ławicka online store sells Goods through it without the simultaneous presence of the Parties, using a telecommunications network.
  • Client: a natural person, private individual or organisational unit making purchases in the Her Karolina Ławicka online shop.
  • Pages: The Seller and the Customer.
  • Goods: the range of products offered by the Seller for retail sale in the Her Karolina Ławicka online shop.
  • Price: expressed in Polish currency (PLN), includes tax (gross amount). Product prices do not include delivery costs.
  • Agreement: a distance sales agreement between the Parties within the meaning of the Civil Code and the Act of 30 May 2014 on consumer rights, concluded via the HER-HER.EU online store.
  • Personal data: Customer's personal data processed for the purpose of fulfilling the Order by the Seller: first and last name, e-mail address, telephone number, mailing address (street, house number, flat number, postcode, city, country).
  • Basket: an electronic order form made available by the Seller on the HER-HER.EU online shop website, through which the Customer purchases Goods.
  • Order – this should be understood as a legal transaction (conclusion of a purchase agreement) carried out using the Shopping Basket, during which the Customer expresses their willingness to purchase selected Goods in accordance with their description and Price. By accepting the description and Price.
  • Order Fulfilment: actions taken by the Seller to deliver the ordered Goods to the address specified by the Customer.
  • Delivery: type of transport service, including the name of the carrier (e.g. courier company) and the cost of the service.
  • Delivery cost: the fee for the delivery of Goods to the Customer, determined by the delivery time and costs specified in the HER-HER.EU online shop.
  • Payments: the act of paying, in the manner specified in these Terms and Conditions, the indicated Price of Goods and Delivery Costs.
  • Proof of purchase: this should be understood as confirmation of the conclusion of the Agreement between the Seller and the Customer, e.g. in the form of a bill, invoice or confirmation of Payment. Invoice upon request.
  • Postal address: full name or name of institution, location in town (for towns divided into streets: street, building number, flat or apartment number; for towns not divided into streets: town name, property number, postcode and town).

III. Using the online shop and placing orders

  • The condition for using the online shop is acceptance of the Terms and Conditions and provision of personal data marked as mandatory.
  • The shop reserves the right to withdraw from the sale transaction if the goods are not available from the supplier. The funds paid by the Customer will then be immediately refunded to the bank account indicated by the Customer.
  • The HER-HER.EU online store may deprive the Customer of the right to use the online store in special cases, such as: providing false information during registration in the online store, or when the data is incomplete, outdated, misleading or violates the rights of third parties. Furthermore, in the event of other behaviour that may be considered by the Seller to be contrary to applicable law, offensive to good manners or damaging to the Seller's reputation.
  • Orders in the Shop can be placed using the Order form available on the Shop's website. To order Goods, select the type of goods and their quantity by adding them to the Basket, and then, after checking that the selected goods and their quantities are in accordance with the Customer's wishes, click the „Buy and pay” button.
  • Orders can be placed by sending an e-mail to: office@her-her.eu. The message must contain the following information: name of the product, product code, quantity, shipping details (first name, surname, address, telephone number).
  • Electronic orders can be placed 24 hours a day, 7 days a week, throughout the year. Orders placed on Saturdays, Sundays and public holidays will be processed on the next working day.
  • The Parties shall be bound by the information contained on the Store's website for the purchased Goods at the time of placing the Order, in particular: the Price, characteristics of the Goods, their features, components included in the set, delivery date and method.
  • When placing an order, the Customer undertakes to provide all information necessary for the execution of the order truthfully. In the event of providing false data, the Shop has the right to withdraw from the execution of the order by notifying the Customer thereof.
  • The purchase can be finalised once the Customer has provided:
    • all the details needed to complete the order,
    • ordered products,
    • delivery method (courier company, parcel lockers),
    • method of payment (details are provided in Section IV of these Terms and Conditions)
  • The contract with the Customer is concluded upon placing the Order.
  • The agreement is concluded in Polish, in accordance with Polish law and these terms and conditions.
  • The purchased product(s) will be shipped immediately, or in the case of payment by bank transfer, once the payment has been credited to the Shop's bank account.
  • When making a purchase, the customer is obliged to pay for it at the time of placing the order using Przelewy24 or at the time of delivery of the goods by the supplier in the case of cash on delivery.
  • Placing an Order and its confirmation by the Customer in the manner specified in point III.1 constitutes a legally binding Sales Agreement between the Online Shop and the Customer.
  • In cases where the Seller is unable to send the Goods ordered by the Customer, the Seller undertakes to send replacement Goods at the same price, selected by the Customer, or to refund the payment for the Goods and shipping, informing the Customer in advance by electronic means.
  • The shop operates within the European Union.

IV. Delivery and payments

  • The customer can make payments via the Przelewy24 system, by card or cash on delivery.

  • The delivery of ordered Goods is carried out via courier service, Inpost parcel lockers, and post office.
  • The ordered Goods are delivered in accordance with the Supplier's terms and conditions.
  • The goods are dispatched to the Customer by the Seller within 5 working days from the date of crediting the amount due to the Seller's bank account.
  • The customer shall cover the entire cost of delivery.
  • Orders are processed and delivered on working days. The shipping cost depends on the payment method, country of delivery and order value.

V. Complaints

  • In the event of non-compliance of the Goods with the contract, the Customer undertakes to contact the Seller within 7 days of discovering the defect by notifying the Seller by sending an e-mail to office@her-her.eu.
  • In the complaint, the Customer should provide their first name, surname, correspondence address, telephone number, date of discovery of the defect, description of the Goods being complained about and a clear description of their non-compliance with the Contract.
  • The shop shall consider the Customer's complaint within 30 days of receiving the Goods.
  • Complaints related to the purchased Goods shall be considered on the basis of the provisions of the Civil Code.
  • Transport costs related to the complaint procedure shall be covered by the Customer.
  • HER Karolina Ławicka takes measures to ensure the fully correct operation of the Shop, to the extent resulting from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
  • The Customer may report any irregularities related to the functioning of the Shop in writing to the following address: Her Karolina Ławicka – with its registered office at Bałtycka 26, 61-017 Poznań, NIP: 7772600353, or to the following e-mail address: office@her-her.eu.
  • HER Karolina Ławicka undertakes to consider each complaint within 30 days of its receipt.

VI. Withdrawal from the contract

  • In accordance with the Act of 30 May 2014 on consumer rights, the Customer has the right to withdraw from an online sales contract without giving any reason within 14 days from the date of receipt of the shipment. To meet this deadline, it is sufficient to send a statement of withdrawal from the contract to the e-mail address office@her-her.eu.
  • Pursuant to the Act of 30 May 2014 on consumer rights, the direct costs of returning goods due to withdrawal from the contract within 14 days of receiving the Goods shall be borne by the Customer (Article 34(2)).
  • Returned goods must not show any signs of use and must have their original labels.
  • Only returns accompanied by a receipt will be considered.
  • Shipping costs are non-refundable.
  • If the Customer decides to withdraw from the contract and returns the purchased product, the Seller is obliged to refund the amount due within 14 days of receiving it.
  • Returns can be made using the aPaczka ProReturns option. The cost of return shipping is PLN 14 (courier delivery) and will be deducted from the refund amount of the paid order.
  • The basis for the refund is the receipt for the purchased goods, which you must attach to the returned item along with a correctly completed return form.

VII. Personal data and privacy policy

  • The data controller is Her Karolina Ławicka – with its registered office at ul. Bałtycka 26, 61-017 Poznań, NIP (Tax Identification Number): 7772600353.
  • Personal data is processed for the purpose of performing the Sales Agreement based on an order placed in the Shop by the Customer, in connection with handling complaints and returns resulting from the concluded Sales Agreement, for technical and statistical purposes of the Shop, for marketing purposes, for sending newsletters, including commercial information, with the prior consent of the Customer.
  • The provision of personal data by the customer is voluntary, but it is necessary for the performance of the Sales Agreement.
  • Every Customer of the Shop has the right to view and update their personal data.
  • The Shop Owner is entitled to disclose personal data administered by them only to entities authorised under applicable law.
  • The information contained in access logs may include various data, e.g. IP addresses. The Shop Owner uses this data solely for technical purposes. The Shop Owner reserves the right to disclose the data referred to herein to entities authorised under specific provisions (e.g. law enforcement authorities).
  • The Shop uses cookies, i.e. small text files sent to the Customer's computer, which contain information necessary for the proper functioning of the Shop, in particular the authorisation process. Personal data is not processed or stored using cookies.
  • Details regarding the privacy policy and cookie policy are described
    in the ‘Privacy Policy’ tab of the Online Shop.

VIII. Final provisions

  • These Terms and Conditions shall enter into force on the date of their publication on the Online Shop website.
  • These Terms and Conditions apply to all Customers regardless of the form of placing an order.
  • The Seller reserves the right to amend these Terms and Conditions. Any amendments to these Terms and Conditions shall be published on the Online Shop website.
  • In matters not covered by these Terms and Conditions, the applicable provisions of Polish law shall apply, including in particular the Civil Code and the Act of 30 May 2014 on consumer rights (Journal of Laws 2014. 827).kompBałtycka 26, 61-017 Poznańul. Bałtyckiej 26, 61-017 Poznań

IX. Terms and conditions for concluding a contract for the sale of personalised products

  • There are two methods for ordering a personalised product: selecting the options available on the product page or sending an email to biuro@her-her.eu.
  • Acceptance of the order form is tantamount to the Buyer's familiarisation with the personalisation regulations.
  • After submitting an enquiry/order, the Seller confirms its receipt by e-mail, responding to the order, specifying the delivery time, and accepts the order for execution only when it is approved and the agreed amount is paid into the bank account or via Przelewy24 on the seller's website.
  • The delivery time for personalised orders is determined individually, unless a specific delivery period is indicated for the product being ordered. If no delivery period is indicated, by entering into the sales contract, the Customer agrees to the order being fulfilled within the specified maximum period of 14 working days. .
  • We do not process personalised orders with cash on delivery; orders are processed after full payment has been made.
  • Personalised products are non-returnable.
  • Consumer Rights Act: Art. 38 The right to withdraw from a contract concluded outside the business premises or at a distance does not apply to the consumer in relation to contracts:

    3) where the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy his individual needs;
  • If a defect is found in the received product, it is possible to submit a complaint in electronic form via e-mail to office@her-her.eu. The message should include:
    the Buyer's name and surname, order number, description of damage or non-compliance of the product with the order.
